These Terms of Service (“Terms”) govern your use of the KS Dynamics website, software, licenses, and related services (the “Service”). By accessing or using the Service, you agree to these Terms.

1) Seller / provider

2) Accounts

• You may need an account to purchase and manage products and licenses.
• You are responsible for maintaining account confidentiality and all activity under your account.
• We may suspend or terminate accounts for abuse, fraud, or violations of these Terms.

3) Products

We currently offer digital products, including licenses, software features, downloadable components, and digital services.

4) Digital licenses

A license grants you a limited, non-exclusive, non-transferable right to use the licensed product as described on the product page and in your account.

• Binding / activation: licenses may be bound to your account and/or a specific device, adapter, or vehicle identifier (as specified at purchase).
• No sharing: you must not share, resell, sublicense, or circumvent licensing mechanisms.
• Updates: we may provide updates to maintain compatibility, security, and functionality.

5) Orders, pricing, and payments

• Prices, taxes (including VAT where applicable), and payment methods are shown at checkout.
• Payments are processed via Stripe and/or PayPal. Orders are confirmed once payment is successfully authorized/settled.
• We may refuse or cancel orders in case of suspected fraud, pricing errors, or legal restrictions.

6) Delivery

• Digital delivery: digital products (licenses) may be delivered instantly to your account after payment confirmation.

7) Returns and refunds

Returns and refunds are described in our Refund Policy: /refund.html. Mandatory consumer rights are not affected.

8) Acceptable use

You agree not to:

• Attempt to bypass security, rate limits, anti-abuse systems, or licensing checks.
• Use the Service for illegal activities or unauthorized access to third-party systems.
• Upload malicious code or interfere with the Service.
• Reverse engineer or tamper with licensed components except where permitted by mandatory law.

9) Intellectual property

All content, trademarks, and software are owned by KS Dynamics or its licensors. You receive no ownership rights under these Terms.

10) Warranty and liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. Nothing in these Terms limits mandatory consumer protections that cannot be excluded by law.

To the maximum extent permitted by law, KS Dynamics will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Where liability cannot be excluded, it is limited to the amount paid for the relevant product in the 12 months preceding the claim.

11) Suspension and termination

We may suspend or terminate access if you materially breach these Terms or if required for security/legal reasons. Upon termination, you must stop using the Service and any licensed components as applicable.

12) Changes to the Service and Terms

We may modify the Service and update these Terms. Material changes will be communicated via the Service or email where required. Continued use after changes means acceptance of the updated Terms.

13) Governing law

These Terms are governed by the laws of Estonia. If you are a consumer in the EEA/UK, you retain mandatory consumer protections of your country of residence.
